1. Complete Disclaimer of Liability & Assumption of Risk

By downloading, installing, accessing, or using TerraMatrix Pro (the "Application"), developed and published by TerraMatrix Technologies and its founders (collectively referred to as "we", "us", or "the Publisher"), you explicitly acknowledge and agree that:

  • ▪ Simulation & Approximations: All mechanical clearance angles (approach, departure, ramp-breakover), 6-gate obstacle evaluations, differential height estimates, and terrain gradient calculations provided by the My Garage engine and HUD are mathematical approximations based on static geometry and user inputs. Dynamic factors (suspension compression, rebound, tire sidewall deformation, cargo payload, passenger weight, tire pressure, and dynamic momentum) significantly alter real-world clearances.
  • ▪ Zero Publisher Liability: Under no circumstances shall TerraMatrix Technologies, its founders, directors, engineers, or contributors be held liable for any direct, indirect, incidental, punitive, consequential, or exemplary damages, vehicle frame/body damage, differential strikes, rollover damage, recovery/towing expenses, lost profits, medical expenses, bodily injury, or loss of life arising out of or related to the use of this software.
  • ▪ Driver Judgment & Spotter Primacy: The human vehicle operator retains sole and exclusive responsibility for assessing trail conditions, terrain stability, water depths, weather conditions, and obstacle clearances. You must never prioritize application readouts over physical visual trail inspection, mechanical ground spotters, or common-sense off-road safety protocols.

2. Location Data & Hardware Sensor Privacy

TerraMatrix Pro is architected with a Privacy-First & Offline-Autonomy philosophy. We treat location data with the highest level of security and confidentiality:

  • ▪ On-Device Local Processing: High-precision GPS coordinates (latitude, longitude, speed, heading, and altitude) and hardware accelerometer/magnetometer sensor streams are processed in real-time on your device to calculate dynamic clearance vectors, render artificial horizon cockpit HUDs, and calculate route progress.
  • ▪ Zero Location Tracking or Sale: We do NOT sell, rent, monetize, or disclose your real-time GPS locations, route histories, waypoints, or recorded GPX trail logs to any third-party advertisers, data brokers, insurance providers, or analytics platforms.
  • ▪ 100% Offline Vector Autonomy: Offline vector maps (MapLibre PMTiles) and topographical contour lines are rendered directly from local storage. The application functions in complete isolation with zero cellular data transmission required in the backcountry.
  • ▪ Background Location Usage: When active turn-by-turn navigation or disaster proximity monitoring is engaged, background location access is utilized exclusively to deliver continuous voice audio alerts and proximity warnings while the screen is dimmed or minimized. You may manage location permissions at any time via your device system settings.

3. Disaster Alerts & Topographical Mapping Notice

Disaster alert feeds aggregated from public agencies (UN GDACS, USGS, NOAA NWS, MeteoAlarm, IMD/NDMA, Australia BOM) and OpenStreetMap/SRTM topographical vectors are provided strictly for supplemental situational awareness:

  • ▪ Dynamic Environmental Changes: Flash floods, rockfalls, washouts, mudslides, snow accumulation, and wildfires alter terrain dynamically. Map vectors and cached elevation contours may not reflect active or immediate changes.
  • ▪ Feed Latency: Public disaster feeds are subject to upstream agency reporting latency. Never rely solely on TerraMatrix Pro for life-critical weather evasion or emergency evacuation decisions.
  • ▪ Not a Satellite SOS Device: TerraMatrix Pro does not initiate satellite search-and-rescue dispatch without dedicated secondary satellite communication hardware (e.g., Garmin inReach, Satellite PLB). Always carry proper emergency distress beacons in remote wilderness areas.

4. Wildlife, Forest Conservation & Land Stewardship

Operators are strictly required to adhere to Tread Lightly! principles and obey all official motorized vehicle boundaries:

  • ▪ Stay on designated legal off-road trails and respect seasonal gate closures established by USFS, BLM, State Parks, Forest Departments, and indigenous land trusts.
  • ▪ Do not forge illegal tracks, enter protected wildlife corridors, trespass on private property, or disturb fragile ecological habitats.

5. Descriptive Trademarks & Intellectual Property

All third-party vehicle manufacturer names, brand logos, model designations, and aftermarket parts references (including Mahindra®, Jeep®, Toyota®, Suzuki®, Ford®, Ineos®, Land Rover®, ARB®, Old Man Emu®, Fox Racing®, Warn®) are the exclusive intellectual property of their respective trademark owners.

Their mention within TerraMatrix Pro is strictly for mechanical identification, geometric compatibility verification, and educational fair use under descriptive trademark doctrine. TerraMatrix Technologies is an independent software developer and is not affiliated with or endorsed by any vehicle manufacturer.

6. Subscriptions, In-App Billing & Cancellation Terms

TerraMatrix Pro offers premium subscription plans unlocking full offline vector map downloads, live edge disaster sync, and 3D Relive export engines:

  • ▪ Secure Billing Mechanism: All subscriptions and in-app purchases are processed through verified platform in-app payment mechanisms. We do not store or process your credit card or financial payment details directly.
  • ▪ Auto-Renewal & Easy Cancellation: Subscriptions automatically renew unless canceled in your account settings at least 24 hours prior to the conclusion of the active billing cycle. You may manage, modify, or cancel your subscription at any time directly through your device account settings.
